Before the application
The applicant needs to:
- Be the partner of an Australian citizens, permanent resident or eligible New Zealand Citizens
- Be in a genuine and ongoing relationship
- Freely consent to the relationship
- Be in a marriage that is valid under Australian law
or
in a de facto relationship for more than 12 months, exceptions apply - Be in Australia at the time of the application and the decision
- Speak vocational English proven by one of the eligible language tests
- Undertake a health examination (country dependent)
- Have health insurance
- Have a valid passport or other travel document
- Cannot hold a visa with a “no further stay” condition
The applicant can include family members:
- Dependent children or other dependent relatives
- Requirements for family members:
- Documentary evidence of the relationship to the main applicant
- Health and character requirements
